But understanding the laws around pet ownership in strata can be a bit tricky. The rules have evolved, and with that comes a few important things to consider before you bring a furry (or feathered) friend into your home.

Recent Changes in Strata Pet Laws: A Quick Overview

In 2024, significant changes were made to pet laws in strata buildings to ensure a fairer approach for owners and tenants alike. One of the key updates was the shift towards “opt-out” pet policies.

In the past, if you wanted to keep a pet in your strata property, you needed to get approval from the Owners Corporation or the strata committee. This often meant a lengthy application process, which could feel like jumping through hoops. Now, in many cases, the default is that pets are allowed unless there is a by-law specifically prohibiting them.

So, what’s changed?

  1. Pets Are Allowed by Default:
    Under the new reforms, unless a specific by-law exists prohibiting pets, owners are free to keep pets in their lot. This change makes it easier for pet owners to live in strata properties without having to go through a formal approval process. However, the strata committee can still introduce a by-law that restricts pets within the building or impose conditions (such as the type, size, or number of pets allowed).
  2. The Right to Object:
    If you live in a building where the “opt-out” policy applies, you can object to a pet being kept, but your objection needs to be reasonable. It cannot be arbitrary or based on personal preferences—it must relate to legitimate concerns, such as damage to common property or pet behaviour that could affect other residents.
  3. No More Unreasonable Pet Bans:
    The new rules provide more protection for pet owners. A blanket ban on pets in a strata scheme is no longer acceptable unless it is supported by reasonable evidence that pets would cause significant harm or disruption to the community.

What You Need to Know Before Getting a Pet in Strata Living

While the rules have relaxed a little, there are still some important considerations to keep in mind when it comes to pet ownership in strata:

  • By-Laws Still Matter:
    Not every strata community has embraced the “opt-out” policy. It’s essential to check your building’s by-laws to see if there are any specific restrictions or guidelines regarding pets. If there’s a pet ban or restrictions, these rules still apply, and you must follow them.
  • Pets and Common Property:
    Even if pets are allowed in your lot, you still need to be mindful of shared spaces. Common areas like gardens, hallways, and lifts must be kept pet friendly. Some strata schemes may require pets to be kept on a leash in common areas or impose additional restrictions such as cleaning up after your pet and ensuring they don’t disturb other residents.
  • Pet Behaviour is Key:
    Pets should be well-behaved, and their presence should not cause any undue noise, damage, or inconvenience to others. If there are complaints about your pet’s behaviour, you may be asked to take corrective action. In some cases, if the issue persists, the strata committee may intervene.
  • Speak to Your Strata Manager:
    Before bringing a pet into your strata property, it’s always a good idea to speak with your strata manager. They can clarify the rules, help you navigate any by-law issues, and ensure that you’re in full compliance with the building’s pet policies.
